Round table on tenants' problems: solutions and the role of Samruk-Kazyna Construction JSC
On 23 August 2024 in the East Kazakhstan Regional Court was held a round table on the topic: ‘Problematic issues arising in the consideration (execution) of civil cases on eviction’. The event was organised to analyse judicial practice and develop proposals for the regulation of social relations related to the eviction of citizens from residential premises.
The round table was attended by judges of the City Court of East Kazakhstan region, representatives of the Regional Chamber of bailiffs and the Prosecutor's Office of Ust-Kamenogorsk city. Gulbarshin Abdigalieva, Director of Legal Support Department of ‘Samruk-Kazyna Construction’ JSC, was also among the speakers.
During her speech G. Abdigalieva stressed that despite the fact that eviction of tenants is an extreme measure, it can be applied in cases of improper fulfilment of the terms of the Lease Agreement with purchase. She noted that tenants should understand that the interest rate under the agreement is low, and monthly rent payments are aimed at buying out the premises, which will eventually become their private property under the terms of the agreement.
Summarising the results, the expert appealed to tenants to properly fulfil their obligations, reminding them that breach of contract can lead to serious consequences, including possible eviction by court decision.
The event was an important step towards resolving topical issues related to the enforcement of eviction judgements and allowed the participants to discuss the problems arising in the process and find ways to resolve them.
