Rented housing with a buyout is one of the areas of the Anti-Crisis Program and the Nurly Zher Housing Construction Program, which were operated by Samruk-Kazyna Construction for 10 years. How the state program works, how late fees are charged, and in what case it is possible to sublease real estate, we will understand this material.

Briefly about the state program: when did it start? How many apartments have been rented out?

Samruk-Kazyna Construction JSC was established on March 6, 2009 to promote the development of the construction industry in Kazakhstan. The company was the operator of the Anti-Crisis Program and the Nurly Zher program.

Within the framework of the Anti-Crisis Program, more than 4.5 thousand apartments were built in the cities of Astana and Almaty. More than 10,000 apartments have been built in 12 regions of the country under the Nurly Zher program in the direction of “Rental housing with a buyout”.

Since 2019, Samruk-Kazyna Construction has not been an operator of state programs for the sale of rental housing with a buyout, and therefore the construction of new facilities is not planned.

 

The tenant is obliged:

timely pay rent and utility bills;

keep the premises and common areas clean and tidy;

pay property tax;

annually insure property;

not to transfer the right to lease for free use or as a pledge, and also not to transfer as a contribution to the authorized capital of organizations;

not assign the right to lease to a third party;

to sublease only with the written consent of the Company;

redevelopment of the apartment for the rental period is prohibited;

overhaul only with written consent;

can early redeem the apartment before the expiration of the contract.

 

Lease payment: what happens if the monthly payment is delayed?

If the tenant is late, Samruk-Kazyna Construction has the right to write off his debts from the guarantee payment. The guarantee payment is the amount of 3 to 5 lease payments made by the tenants to the account of Samruk-Kazyna Construction as security for the performance of obligations.

After the debt is written off from the guarantee payment, the tenant is sent a notice of violation of the payment deadlines. If within a month he does not repay the debt, then the materials are sent to the legal support department for collection by means of an executive inscription. If this measure was also unsuccessful, then the Legal Support Department initiates a lawsuit in court and the process of terminating the contract and evicting begins.

 

Penalties: how and when is the penalty charged?

 If the tenant has not paid the rent or guarantee payment on time, then for each day of delay, he is charged a penalty in the amount of 0.1% of the overdue payment amount daily.Пеня рассчитывается следующим образом:

For example, the tenant has a monthly payment of 100,000 tenge. The control date of repayment is before the 20th day of each month. Let's say he didn't pay the rent on May 20th. If the tenant repaid the debt on May 25, for the overdue 5 days he is charged a penalty in the amount of 500 tenge.

 

Is it possible to sell rental housing or sublet?

You can sell an apartment only under one condition: if it is owned. According to the terms of the agreement, any tenant can buy the apartment/parking space/commercial space ahead of schedule. After that, he can independently dispose of his property.

It is also possible to sublease housing only on one condition: the tenant must contact Samruk-Kazyna Construction and obtain written permission. However, many people ignore this rule. If it turns out that the tenant sublet the apartment without approval, he will have to pay a fine of 4 monthly rental payments. Investigations are carried out to detect violations.

The analysis showed that some of the troubled tenants sublet their apartments, including to foreigners. However, they do not use their profits to pay off their debts.
